If a lis pendens just landed on your property — or you've been served and seen the term — it's alarming. Let's take the fear out of it: here's what it actually means, what it doesn't, and the question most people are really asking — can I still sell? (Short answer: yes.)

What a lis pendens actually is

"Lis pendens" is Latin for "suit pending." It's the public court notice your lender files to start the foreclosure lawsuit, recorded against your property here in Volusia County. Receiving one is serious — but it's the beginning of the legal process, not the end. From here you typically have many months before any auction.

What it does — and doesn't — mean

  • It clouds your title — you can't sell completely free-and-clear without dealing with the mortgage. But that's normal: at any sale, the loan is paid off at closing.
  • It does not freeze you in place. You can still sell the home.
  • Once you're served, it starts a 20-day clock to respond in court.

Can you still sell? Yes — and it's often the cleanest fix

You can sell your home any time before the foreclosure auction — even after a lis pendens, and even after a judgment — as long as you close before the scheduled sale date. At closing, the sale proceeds pay off the loan, which resolves the lawsuit and clears the lis pendens.

So a lis pendens doesn't block a sale — selling is actually one of the most straightforward ways to make it go away. And if your home is worth more than you owe, you keep whatever equity is left after the payoff, instead of risking it at a courthouse auction.

What to do if you've been served

  • Don't ignore it. The clock is real — but you have more time than it feels like.
  • Get a read on your timeline and equity so you can decide with real numbers, not fear.
  • Then pick your lane: sell (if you have equity), a short sale (if you owe more than it's worth), or a legal defense / lender workout (if you want to keep the home). A free HUD-approved housing counselor (hud.gov/findacounselor) can help with no sales motive.
